*Any CPA's Here???* Questions About Filing Taxes

Ok, I'll try to be as simple as posible. Met a foreign national, brought her over legally on fiance visa. Got married in Sept. She is unable to get a SSN# until her change of status is accepted by INS. What if anything does this do for my filing status when I go in next week??? Can I still file married jointly? It would be great, as my overall tax burden/braket would drop and standard deduction wold go up, therefore meaning more money in my pocket this year, as I get taxed as single zero thru the year.

She will need an I-10 (taxpayer ID number) until such time as she gets her SSN. She will need to fill out a W-7 form to get the I-10.

NOTE: This information did not come from the knowledge base of the below signed. It came from his wife @ 0530 in the morning. The below signed cannot guarentee anything from his wife at 0530.

CORRECTION!!!!!! See I told ya.
She needs an ITIN, Individual Taxpayer Identification Number.
If you use a tax preparer, they will know what you are talking about, in most cases.

Just do whatever ya wanna do to get yourself the biggest refund. The IRS will let ya know if ya shouldn'ta done it!

i am a CPA, if she can not get an ITIN or SSN in time you can file an extension until oct 15, or you can file married filing separate. Married filing joint will give you the biggest refund though.

Instead of asking here he should be using a qualified tax person , either a CPA or enrolled agent . Don't use H&R Block part-timers or those preparers sitting in WalMart . They can't represent you if you are audited .

I AM CPA i have my own firm i am not H and R block

Sorry if you misunderstood my message . I didn't intend anything derogatory towards you . I meant he seemed to be asking for help in filing taxes on his own using TurboTax or something like that . The info he gets online won't help him in an audit . I respect the knowledge and ethics of CPA's and enrolled agents and always recommend them .

NO offense RickG, i agree with you, i believe a good CPA will save you more than doing it yourself if you have more than a straightfoward return. and if you have something questionable they will at least a good one will help you deal with IRS

Thanks all around guys. How to go about getting the ITIN though??? She can't get a SSN until we file the adjustment of status on her visa. Cant file visa AOS until I get my tax refund.

No, not doing the return on my own. Was just at work away from home and had a few questions.
