Been reading a few posts here lately about bad fuel. Everyone says to keep your fuel reciepts. Are these petro stations liable by law for selling contaminated fuel? What recourse do customers have? Thanks

 

I had a situation many years back where anti freeze ended up in my fuel. It took out my Cummins ntc 350. I was getting my fuel from Texaco. The problem was try to prove they where responsible. Even though others had anti freeze showing up in their fuel and getting it from the same source. So of course you end up with a David and Goliath situation. I payed for the repair for my engine and I never bought anything from that source again.

 

Every person I know who has run into this situation has been compensated by the station without any hassle at all. My thought is they know they were in the wrong from other complaints long before you lodged yours.

 

My working buddy pulled into a Exxon truck stop in the middle of the night pulling his rodeo horse trailer, said he starting filling up right next to two 18 wheeler's, ------said he was at the back of the truck when the first 18 wheeler started sputtering then died, the second was right behind that one, it died, he ran to his cab and tried to kill his motor, but it was to late, it died.

Turned out they all recieved massive amounts of water, killed his IP and lift pump , there happened to be a Dodge dealer in town and the mechanic said he thought the short block would be ruined also, they pulled it apart and everything checked out OK, except for the IP and lift pump-----

To answer your question, yes, the station took care of everything in the way of repairs, they called the owner that night and got her down there, they should have insurance.

 

So far I have been lucky enough not to find out if the stations are liable on my truck, but here recently my daughters 06 Honda Civic was not. She got the dreaded water contamination in the fuel along with several other customers and had to have the fuel system cleaned out at the dealership. I went ahead and paid for it and the station owner came through pretty quick with a check for us. They do have insurance so be sure and get a cash receipt each time you fuel up if you pay with cash especially, you never know when it may happen to you.

The hard part like someone already said is trying to prove it is that particular stations fault. Most will of course deny it and it is your word against theirs.

 

My brother-in-laws brother filled up and they got just a few miles down the road and it started to spit and spuder and it turned out that he got a tank of 93 octane He checked the recept and it said that he filled up with #2 they checked at the station and it turned out that he was the first to fill up from the #2 only pump and the Tanker put the wrong fuel in the storage tank. They even had it on film. Him and the tanker. They paid to have the hole Fuel sistem replaced fuel lines, filters, pump, injectors, everything. still sucks that it was a 04.5 with less than 1K on the odomiter. Keep your recept and watch wich nosle you use.
