Look at it like this, your talking about a gallon in a 35 gallon tank, they can tell the concentration, if you get checked, tell them you grabbed the wrong pump and got a couple gallons before you noticed....

And its people like me that is a father that would have the afore mentioned boys ********* hanging from the reciever hitch on my truck....

O.K., I think a couple of the replies were questioning the same thing i am...not whether or not he actually put red fuel in, but whether he ONLY put red fuel in. How upset was he? If he went through the trouble of prying off your cap, maybe that "red" fuel was cool-aid or 1/2 fuel and 1/2 water, or all water, or...????

Because if there's no evidence of the "red" he might just be messin' with yer head.
If I was going to go to all the trouble to pry your fuel cap off because of my daughter, diesel fuel would be the LAST thing I'd think about adding to your tank.

You guys bother to get way too many details for these hypothetical situations, you know that? Details details details...

The old man has a 70 gallon transfer tank in the back of his truck (which happens to be a gasser F-250), and I saw him pump the red from his tank into mine. So unless his tank is full of water, I'm pretty sure that it's just Diesel.


Maybe I can try a simpler scenario. Let's say that I don't like Shovelhead because he likes UCLA and I like USC. So I put a gallon of red in his tank. A week later, he gets dipped and in trouble. What happens?

Can he take me to court? Or is he totally out of luck?
It seems like a pretty good way of smacking somebody to me. I can't think of anything good to do in the situation.

I would go with the simple mistake story and hope the DOT officer isn't reading this forum... Unless you have pictures, I dont think you have a leg to stand on.

better yet, call your local DOT office tommarow and tell them you have a couple gallons of red in your fuel tank and you need to know where to pay the taxes on the fuel.

Well, you have a couple of choices to stay out of trouble. One, drain all the fuel into your tractor (or your neighbor's if you happen not to own one) or your power boat. Two, put a "Farm use" plate on your truck.

1. If he pryed the gas cap off ... it is vandalism (which is illegal, even in California).
2. Stop messing with his daughter. I doubt he would be that ticked if you were acting like a gentleman.
3. After you file a report of vandalism, drain the tank just in case there wasn't other goodies in the stuff ... or take your chances with $$ repair costs (your call).

... oh yeah, and did I mention STOP messing with his daughter ??

Perhaps there was a pound of sugar in that jerry can before he pumped in the diesel...
He may not be looking at a tax evasion senario, he may be trying to set you up for a fuel theft charge.... That may be simpler to do than getting the dot out there to dip your tank.

If you saw him pump it into your tank, it's no longer a hypothetical situation.

IF big if, you got 'dipped' I'd explain it to the DOT officer exactly as it happened. A gallon or so of RED to a full tank would be a pretty weak dilution.
Fathers of teenaged daughters have been know to do far worse to boyfriends that they didn't approve of.

OH,.......and stop messin' with his daughter.

I would drive it, wait a couople of tankfulls, then when you go over to see his daughter, thank him for the free fuel.

By the way, the sugar thing is a myth, it doesn't do anything to an engine.

File a report of what happened with the local police, sheriff, or whatever yall got over there in that part of the world. That way if you do get dipped, you have something to stand on in court. As you stand right now, it is your word against the DOT if you do get dipped. If you bring it up in court that he put it in there, then the judge will say where is the proof? And your answer will be (determined by your next course of action) here it is, or I don't have none other than my word.

He may be right...
Think of how easy it is for him to say you are stealing his fuel, and so then they dip your tank and it comes up red. Then its either you vs him for fuel theft, or you vs dot for red fuel.
