Question Programmer for tires *BUT* needs to be OK in CA

So I have 315s on my '06 and my actual per GPS mph is 3-4 faster than what my speedometer says. It was exact BEFORE I brought it to the dealership because I thought my gauges were off due to the gauge check. (the speedo will only go to 100mph(?) instead of full scale)

They checked to see if my tire size was right, and they said A OK. Now it is off

What I would like to know is what should I do, is there a programmer that I should get that would be OK with the California recall?

OK, different question. What programmer should I used to fix my tire size issue? Or: Do you think a tire shop/dealership would be able to set my tire size to 315s?
