"D" or "E" is not an absolute. When changing tire size within 1 load range the carrying capaicity changes (i.e. 235/85/16E = 3042# single while 265/75/16E = 3415# single).
If your specific "D" has the weight capacity as the factory "E" you can safely load up to the GVW with absolutley no liability added. Beyond that it's a gray area that needs to be considered.
I've never heard first hand of anybody (private vehicle) loosing a lawsuit because they were a bit over GVW, but within per axle and tire specs. Of course lawyers can sue for anything...that's what they do. I run 1k# over my GVW and a lawsuit for it is the least of my worries.
Several people on here have documented that certain DOT's don't care about GVW either, but rather per axle and per tire.

Empty the rear axle has about 3k#'s on it.
