Fuel

I just recently pumped high sulfur off-road fuel into my truck. Does anyone know of any possible effect from this.

Re:Fuel

The only effects I've heard of are a sudden rapid lightening of the wallet when caught using untaxed fuel in an on-road vehicle.

Re:Fuel

beside the gapping hole that is left in your wallet by DOT , you will shortly be reciving a little letter from the IRS , something about tax evation , but if you don't have to pull into the scales or commercial tags , the odds of gettin pinched or real slim

Re:Fuel

Here in VA the difference between on road and off road fuel is the 1) tax on on road, 2) dye in the off road, and 3) the on road is low sulfur..

As far as dipping the tank.. they DMV uses a pipett (sp - but looks like a long think straw) that they put down in the tank and then put a finger over the end.. then pull the pipett out and due to vacuum pressure you have fuel in the pipe.. if the fuel is clear they release the finger and the fuel goes back in the tank.. if is is dyed they pull a sample to send off for testing, then you have a seat in the car with the pretty blue lights while the nice LEO writes out that ticket.

From what I understand it may take quite a few (6ish??) tanks of fuel to get the dyed out of the system..

Re:Fuel

As a follow up.. The fine is $1,000.00 for first 100 gallons of tank size.. For tanks over 100 gallons it is $10.00/gallon - tank size..

I think if you have bulk tanks and that is where the dyed fuel came from they are assessing you on the bulk tanks as well..

Plus have to pay the state tax on the fuel AND the IRS follows up with a bill for the same fine ($1,000 or more) issued by the state and you owe the federal tax ($0.244/gall) as well.

Re:Fuel

I may as well post what I know, beings a buddy of mine just got dipped.

My buddy is an electrician by trade, His work truck is a 2000 Power Stroke. The IRS pulls in where he was doing a little wire job one day ( just a few weeks ago ), a lady gets out of one side of the car flashing credentials telling him that they are dipping the tank, as a man is handing him a piece of paper that has written "If you don't let us your screwed", well it wasn't that exactly. The guy sticks a little hose down the tank with a little suction pump on the other end and low and behold, the fuel was red. My buddy acted dumb, tried the "I bought #2 fuel from the fuel man up the street for on the farm, I thought #2 fuel was supposed to be red" line, but that didn't work. Turns out they wanted to see the tank the fuel came from. They followed him home 10 miles, so don't think they won't travel, took two more samples of the fuel in the 165 gallon tank, and gave him a fine of $400 for the 40 gallons in his truck, and $1650 for the empty 165 gallon transfer tank on his farm.

Just talked to him the other night and he said they didn't give him the fine on the spot, they just told him what it would be, that 1 sample from his truck and 1 from his tank will be sent to Maine to a lab to make sure that he actually did put fuel in out of his tank. Thank goodness the Dodge was parked inside the barn where it couldn't be seen, or they would've dipped it also.

IMO, I believe it's a little cheaper just to pay the tax at the pump.

Rick

As far as dipping the tank.. they DMV...[/quote]
In Idaho the state does not dip tanks and there are no roadside dip stations. It is only done by the IRS and only at weigh stations. Many farmers put dyed diesel in the pickup & truck tanks and the state doesn't want to upset them. IF they are caught by the IRS, and if they have other violations the state is after them for, they can be prosecuted. The state fine, if they are found guilty, is min. $100, max. $1,000. So far I've not heard of the state prosecuting dyed fuel.

...uses a pipett (sp - but looks like a long think straw) that they put down in the tank and then put a finger over the end.. then pull the pipett out and due to vacuum pressure you have fuel in the pipe.. if the fuel is clear they release the finger and the fuel goes back in the tank.. if is is dyed they pull a sample to send off for testing,...
Here, about 50% of the fuel which appears clear is sent in for testing (usually from farm vehicles - the IRS doesn't care if they upset the farmer) because of the residual that will show up in a test but not to the naked eye.
From what I understand it may take quite a few (6ish??) tanks of fuel to get the dyed out of the system...
...then you have a seat in the car with the pretty blue lights while the nice LEO writes out that ticket.
In Idaho no state, county or city LE enforces the dyed fuel, so no pretty blue lights nor tickets. The IRS sends the fuel in for testing. If it is positive you are automatically mailed a "ticket" with a fine of $1000 to be remitted immediately.
