Well... This Sucks. Uninsured Motorist

I’ve had a bad… well, can’t really say bad, lets say eventful couple of weeks. First I was almost killed in a house fire and then today I was in a wreck on the freeway on my way home. I am helping a friend of mine paint his new house and he lives about 30 miles away from me. I was on the interstate during rush hour traffic traveling at about 55 mph when the cars in front of me stopped for whatever reason. I stopped in plenty of time and I noticed that the guy behind me was having a little more trouble stopping but got stopped long before he hit me. The guy behind him didn’t even consider stopping at all and plowed into the guy behind me and pushed him into the back corner of my car. This guy was pretty fortunate because he took one heck of a lick from behind. I could see what was going to happen and I tried to move out of the way as much as I could but I just didn’t have enough room. The guy behind me tried everything he could to miss me but he didn’t have any control after he was hit.
Well we pulled off to the side of the road and an off duty State Trooper happened by and told us to pull into a nearby parking lot for safety (smart decision). It was pretty obvious what had taken place and the guy that caused the wreck got the ticket (tickets).

Now this is what burns my… well you know. The guy that caused the wreck was driving on a suspended license, had been stopped many times for driving on a suspended license, and didn’t have any insurance. He was driving an old beat up jeep so he has lost nothing in this wreck. The guy that he hit (behind me) luckily enough was driving a rental car so it isn’t going to affect him (though I figure the rental agency is going to be p.o.ed). I have uninsured motorist on my policy but it just gets under my skin that this guy is going to get off scott free. Especially since this is not his first time to do something like this.

Oh well, What do you do? It could have been much worse. I could be lying in a hospital bed right now, or worse.

Here is the little bit of damage that I took:

The real problem is with the courts. They need to lock those people up, so they learn there will be pain for driving suspended or revoked. I had one actually ram me on purpose, then run. I feel your pain.

Good luck with the insurance. I hope you don't have to put anything out of pocket. Mine cost me a grand.

Me too... I spoke with my insurance company tonight and described the whole incident to them. I asked them if my policy would go up if he didn't have insurance and I have a uninsured motorist policy and they said it wouldn't. We'll see about that. I won't hold my breath.

Dang, with your string of luck you might want to stay at home for awhile! Glad you arent hurt though. And its always the suspended license/uninsured drivers that cause the wrecks and get off with a slap on the wrist. Oh well, good luck with the insurance company...

first get new keg. actually get two and keep one in the kitchen fridge and put the food on the table.

THEN stay inside to avoid future harm.

Ditto on the spare keg!

Glad to hear no one was hurt.

My brother's now ex-wife was in a similar accident....Only difference, the guy that hit her was an illegal, working in this country, without a green card, no US drivers license, and no insurance. My brother got there just before the cop and had a nice conversation with the illegal...went something like this....
Bro: So, if I had an accident like this in Mexico, with no insurance and no drivers license, you know what they'd do to me?
illegal: Si
Bro: Put me in jail, right?
illegal: Si
Bro: But you are just going to get off, right?
illegal: Si

Conversation with the cop:
Bro: Can you arrest this guy?
Cop: He doesn't appear to be intoxicated...no. Did he threaten you?
Bro: No....Is there anything we can do to keep this guy off the street?
Cop: Not unless he has a record...and according tot he name on his Mexican license, there's no warrants.
Bro: What about the border patrol?
Cop: I can't make that call.

Tony,

I understand where you're coming from. But this guy that hit us was no different in my opinion. He will get off with a slap on the wrist and nothing more. Unless he spends some serious time in prison (not jail) then it will amount to nothing to him. He has lost nothing. This is the guy that raises all of our insurance rates. I did nothing wrong today (unusual, I know) but I will pay the consequences.

Glad to hear you(and all the others) are not injured badly. Above all, remember that, ok? Don't sweat the consequences if you have U/M coverage with a reputable ins company. My total-out T-bone accident almost a year ago from hit-n-run driver(a Ferd p/u of course - Boo! Hiss!) went under U/M with SF(can you say 'state' and 'farm'). They neither charged me with the accident nor raised my rates - yet. Paid my 81 Trailduster off($4600) within one week(but I still have it), paid all medical bills incurred within one week of receiving them ,and has offered a fair amount for personal injury($20k). All this went quickly/smoothly under my Uninsured Motorist portion. Shouldn't have mattered I carry 300,000/500,000/300,000 coverage on all my vehicles, right? ;-) Best part, it hasn't affected my accident-free discount, eh? :-) Now they ought to be really happy since Sunday morning last, a deer ran straight into the right bedside on the highway, smashing in the front panel and ripping the right fender off(the one you can no longer get...of course...). Tue morning they came out and adjusted the basketball size damage and paint to match @ $3,000 and cut a check on the spot. Point is, they will probably do the same for you, so don't work yourself up over it just yet, okay? Hope your experience is similar(And remember!! You came out basically intact where I did not). Good luck to you and it goes w/o saying - Be Careful & Stay Safe!! We need people like you out there...so WE don't have to sweat the BIG stuff! Like fires, and accidents, and plane crashes, and medical emergencies, ad infinitum...Thanks for doing your job, I know I couldn't do it!

Sorry to hear about all you bum luck. Hope it works out for you.
My wife was rear ended in Apriof 2000. The guy had insurence, but was the minimum, under insured motorist. We have underinsured coverage. The lawsuite to recover for additional medical, and pain is still going on. She will have to make another trip to Washington State in December. It is going to arbatration.

Good luck, and tap another keg.

Oh I know... this is no big deal at all. Katelyn could have been riding in the car seat in the back seat and it could have been a semi that hit us. That, my friend would have been a big deal. This is just cosmetic.

I talked to the the adjuster with my insurance this morning and I have uninsured motorist on my policy. If this guy truly doesn't have any insurance then my uninsured motorist coverage will take effect on my policy and it won't cost me to repair my car and hopefully my insurance rate won't go up.

What makes me angry is the guy that hit us has no incentive to get insurance or to get his license. The only thing that is going to give him this incentive is prison time. Not jail time, there is a big difference. I've spent the night in jail when I was a teenager but I have never been to prison.
