I hadn't heard about this one...


I guess that since city councils are elected, it is still possible to counter the laws through grassroots demand... But that's theoretical at best.

At least the law only gives cities the right to confiscate land.

I just heard about this too. This goes against everything the United States was founded on. It is an absolute disgrace.

There was a man here in S. CA that said "I am glad that was the ruling. It will just make my expansion go even quicker." He owns a Mercedes dealership in Los Angeles and was talking about how his company would generate more revenue for the city and state than the Cafe and nearby homes. I guess he did not realize that it would be aired to everyone around him.

Go ahead. Try and take my land. I dare you. They are gonna end up losing more cops, military, and time than it's worth. Nobody, and I mean NOBODY is taking my land without a fight. The law be damned.

Very well said. I feel the same way you do, and with a sub division going in around mine and my neighbors properties all totaling about 40 acres, all I can so is " They can take my land, my family, and guns at the same time. Because If they have taken any one of them away form me, it is because I am DEAD!!

This just became the hot topic issue for next year's mid term elections. Glenn Reynolds at Slate sums it up perfectly.

I predict that this will be a big political issue, on both the left and the right. For Bush and the Republicans it's a big vulnerability -- if they don't do anything about it, many conservatives will stay home in disgust at the next election. On the other hand, if they do something -- like, say, backing Congressional action to limit takings for private use -- they'll offend wealthy real estate developers, merchants, and influential local populations. They'll be squeezed, and I don't think that "help us confirm our judges to reverse this" will be a sufficient answer, though they'll try to make it one.

On the left, it's seen (rightly) as a victory for the hated Wal-Mart, and as a rule whose burden is sure to fall mostly on the poor. (When did a city ever level a rich neighborhood for this sort of thing?) On the other hand, the left isn't big on limits to government power, especially in the economic sphere.

It's certainly a hot issue on talk radio and in the blogosphere already. I suspect it'll stay that way through the 2006 elections.
On a personal note, I suspect this will also create a chilling effect on the housing market. As more folks realize their home is no longer really theirs, what's the point in buying? Especially in areas that are being developed. A truly sad day for our country.

There is a case with Walmart going on in the Birmingham area, pretty upscale neighborhood. It is not just the poor, Walmart does not care. All this did was change the pricing. Now the buyer gets to name the price instead of the seller.

Personaly in the "new" America, I don't see any real reason for a President, the Supreme Appointed Kings rule the country. We have been SAKed.

Emminet domain. In St Louis Missouri, a developer wants to build a shopping mall and is working with the city to have aproximately 200+ homes removed for the development.

WTH! If it happens, you will never see me or my family in that shopping mall. Its a matter of time, before bullets start flying.

DId I read that report right? They are looking at getting rid of up to 10 THOUSAND HOUSES???
If all the owners that don't want to sell simply sit tight, they are going to have a HUGE public relations nightmare on their hands as they daily will have to DRAG owner after owner out in shackles as the TV cameras roll... Especially as they drag the 80+ year old couple out of their home of 50 years... I'd be watchin' my back if I were a developer or a politico that is involved.

Years ago, there was a disgruntled service customer of a certain Ford/Lincoln dealership here in town that went on a Demolition Derby after hours with a BUNCH of BRAND NEW and Customer cars in to be repaired!!! This guy wrecked the whole front LOT!

I'm wondering how long this guys Mercedes inventory will stay pristine...

just goes to bolster my theory on land "ownership" , we merely rent it, in the form of taxes and eminant domain is just a fancy way of saying eviction.
