Gun Control ?

Just wanted to get the opinion of our LEO's about this. This is the first I have seen this and forgive or delete if its been gone over since this was from Katrina.

Has the old expression "gone to hxxx in a hand basket" mean anything.

I am afraid we as citizens have lost all of our rights.
I have heard this happened but this is the first documentation i have see.
oboy and H.Security are taking our rights away, each and everyday we loose a little more..

One of the sad things is our elected officials just turn their backs on something like this.
Law E (police) will bend over backwards to charge you with civil-rights violation at the drop of a hat.

They wouldn't have done that here!! However Katrina was a nasty event and I can understand why they confiscated weapons, but it should have been done properly.

It should not have been done at all.

For reference, check your state law and see if you've got a provision or bill signed preventing this. Immediately following this event Texas passed a law that guns will not be confiscated in an emergency. (I can't find the statute right now)



The Feds actually did as well:
Government Code Section 433 (State of Emergency):
Sec. 433.0045. FIREARMS. (a) A directive issued under this chapter may not authorize the seizure or confiscation of any firearm or ammunition from an individual who is lawfully carrying or possessing the firearm or ammunition.

(b) A peace officer who is acting in the lawful execution of the officer's official duties during a state of emergency may disarm an individual if the officer reasonably believes it is immediately necessary for the protection of the officer or another individual.

(c) The peace officer shall return a firearm and any ammunition to an individual disarmed under Subsection (b) before ceasing to detain the individual unless the officer:

(1) arrests the individual for engaging in criminal activity; or

(2) seizes the firearm as evidence in a criminal investigation.

That’s my thinking also. Most of the LEO’s were never trained for that situation. The superiors who issued orders telling them to confiscate weapons had the intent of taking them away from the bad guys especially after some of those idiots (mostly looters) were shooting at rescue helicopters. Things got carried away.

Sitting in my comfortable chair, in front of my computer I can’t imagine confiscating law abiding citizens weapons. However, I wasn’t there. I can’t put myself into the mindset of the Officers who were dealing with a lot of panicked people in addition to the idiots who stayed behind just to loot.

Bottom line is yeah, they should not have confiscated those weapons. Hopefully the lessons learned regarding the violations of gun owners rights are being passed on to the newer LEO’s.

It has been posted before, but a very good example of what is headed your way if things go south. 'law enforcement' knows where you are and what you own. That is what gun registration is for. So when they want them, they can come and get them, or destroy or kill you trying.

There were just to many examples of over reach. Why is the first thing to go in a 'crisis' our rights???

I can't believe that anyone would ever support disarming the population in times of tumult and chaos like Katrina. THATS WHEN WE NEED THEM MOST!!!

Someone please explain why we have to enact legislation to protect rights given to us under the constitution? I guess now a days it is a constitution of convenience, or a non-crisis constitution. I guess I would like to read the crisis constitution, or the one we differ to when the government decides the 'real' one does not matter. Obviously the second amendment was ill conceived. How could our founding fathers ever conceive of an over reaching, intrusive government taking our weapons away. Hmmm guess they didn't really mean we have the right to bear arms. I guess they meant we have the right to bear arms until the government says we don't.

Funny thing is all this time I was under the assumption that we were 'allowed' to have weapons to protect ourselves from the government.

I find it shocking that the mayor of a city, as poorly run as NO, has the power to overturn a citizens rights on national television, without any fear of retribution, incrimination or incarceration. Actually come to think of it, I don't find it shocking at all...

One of these days their gonna knock on the wrong door, push the wrong person around, reach a little to far, and the powder keg they have created is gonna go off. I just pray no one gets hurt. Cause if they do, it will never be the government 'representative' that is at fault, it will always be the citizen that gets trampled.

We either have the right to ownership or we don't, there is no grey line.

I hope you are being funny, because they have, and they will. You should plan accordingly. I would like to know exactly how it is that you remove the bill of rights from our constitution 'properly'. Maybe you can explain that for me/us.

That is why NONE of my firearms are registered, nor will they ever be. Yes, I have a CWP, but that could be for the baseball bat I carry :-).

If the Feds wanted to find guns the first thing they'll do is collect the 4473s from FFLs and run down the list. Whether or not they find the gun listed on that particular 4473, they will know at some point or another this person at this address obtained a firearm or transferred a firearm. It's a starting point.

Next, if they can, try to strong arm states for their CHL lists.

Yup. As the American Rifleman has pointed out, they keep trying to pass laws to make "illegal guns illegal". Huh?? If a felon isnt supposed to have a gun, its already illegal for him to have it. Same with the already illegal guns being smuggled into Mexico. They need to concentrate on enforcing the current laws and quit trying to make new laws with hidden agendas.

The fact of this is LEO's shouldnt be allowed to break and enter you home and remove (by force) your (OUR ) weapons.

I am afraid if that were the case for my home, there would have been bloodshed. The fact that this actually happened, doesnt this give the LEO's a bad rap? How is this possible to have even happened?

The actual legitimate LEO's out there should have been in an uproar about this !
