In MA someone has to witness you driving and be willing to testify.

Not true . I know a couple of people that were arrested sitting in the vehicle . Another went in a ditch . Walked home and rode back with a tow company an hour later . The cops were there and arrested him for DUI even though he was never seen in the vehicle . Yes , he was convicted .

 

In Iowa "operation" requires the motor to be running; just having the key in the ignition doesn't qualify. Our law also states "anywhere in the state", so whether it's on the roadway, ditch, or a farm field there's no exemption.

 

I once decided to sleep off a drunk in my car. I decided it would be better to utilize the passenger seat, so there would be no question of whether I was intending to operate my car if an officer did spot me.
Sure enough, about 0630, I awoke to a tapping on the window; it was Boone County's finest. The cop asked me what I was doing, and I told him I had left a party, too drunk to drive, and decided to sleep it off. He checked my licence, registration, and insurance; asked me if I felt ok (I did except for a powerful hangover), and sent me on my way. He actually thanked me for being responsible, but told me if I had been in the driver's seat, I'd have gone to jail.

 

I wonder if you were sleeping in the back seat with a club on your steering wheel if that would count towards "intent to drive"? Also I wonder how they would treat the situation if you told them you were too tired instead of drunk to drive. I'll ask my bro-inlaw about the AZ laws.

I was following a guy who was drunk. He almost hit a runner on the side of the road and crossed the centerline many times. He finally pulled over. So I went to the police station to report him. I got a call from the arresting officer later. She said the guy was so drunk when she told him to get out of the vehicle he fell flat on his face. She also said that I would have to testify in court against him because I saw him driving and she didn't. So I did.

 

No - I believe he was responsible for the "failure to render assistance" law...

 

So where can one research the exact wording of the DUI laws and laws surrounding it? I've spent many a night sleeping in the back seat or passenger seat of my truck, and now you fellers have me worried...

 

I was In Cedar Rapids Iowa, Walking WALKINg home from the bar 2 blocks down cop came up arrested me for Public Intox. Which would be fine if I was intoxicated. But Got downtown. Had to pay 6 bucks for a breathalizer and bliew a .027 OWI is .08 Still kept me because it was up to the officers descretion Dumb
