HELP! When should I persue legal advice/action

Exclamation HELP! When should I persue legal advice/action

Okay, State Farm's claims estimator came out and took a second look at the truck today, and he still says that everything but the wheel/tire and bumper step pad was previous damage! He says the leaf spring is not bent, he says his on his truck looks the same way My knees are still shaking after talking to the body shop, they tried their best to convince him, but he wouldn't budge. I am trying to get State Farm to do SOMETHING, they don't even have to pay for it, Farmer's Insurance does I left pictures with the body shop of before the accident, and the body shop said the claims guy didn't even want to look at them! This is a different person than before, also.

Anyway, I am sure a few of you guys have been in a similar situation before, and what did you do, or what should I do? Thanks in advance

If you have a couple of estimates showing damage, and the other shops are saying it isn't previous damage, it might be time to talk to the adjuster's boss.

I cant remember the name but theres a state insurance commissioner. If you have various reports stating all the damages I would think this will help. Sounds like he`s scamming you. Someone just got busted for somekinda of customer ripoff like this recently. Wonder if it would possible to have a different estimater from a friends ins co write it up.

I finally started to get to the bottom of some of this, and the State Farm "inspector" called everything else prior damage. I questioned the claims person on the phone and they are incredible penny pinchers! Anyway, I talked to the body shop again and the guy called his boss (who is on vacation) and told him about it. He couldn't believe it. The owner of the body shop, Jaimie, and I have talked before and he had scheduled yesterday (thurs) for the re inspection so that he could be there, but the State Farm guy didn't show. He left this morning and then the inspector showed up So he will be back on Friday and said he'll take care of it. He said customers come first, and insurance comes second.

Thanks apache, that's what I was looking for. I want these two estimators to be recognized for their ignorance.

Oh, and I found out how they "spin tested" my wheel at the first shop (to prove that the axle wasn't bent ), they drove it in the parking lot and the State Farm inspector watched the wheel and said it wasn't wobbling, so everything is good I can't wait until next friday...

Who keeps insurance CO. honest? Everybody is always looking over us to see the we don't cheat or pull one off but who polices insurance?

Man I would be looking for a new insurance company, and trying to put that adjusters neck in a wringer. I would do everything in my power to get him in trouble or even fired. Who knows how many people he has hosed over in a similar fashion that just took it in the shorts and kept quiet. If he is trying it on you he has already gotten away with it before and will try again in the future.

I got hit by a guy who was insured with State Farm. It was one of the most frustrating things I have ever gone through. And yes, the estimator wanted to right off almost the entire accident as "prior damage".

Get an attorney involved if you can swing it. Otherwise you are gonna take it in the shorts. It's unreal that the person who hit you was drunk, and then you have to put up with all this crap to boot!

Snake Farm Ins. is more like it, don't even waste time with this person as he will continue to just PI$$ you off. Get a lawyer! If you can prove it was not previous damage then for sure get one. But hey wait a minute even if youhave previous damage and someone hits you ontop of the old stuff who cares, bottom line that's new damage in my book!

My wife used to work for a law firm. She said that State Farm is one of the worst insurance companies to deal with.

Good advice...I'll stay away from the Snake Farm!

There HAS to be some kind of governing agency that deals w/ insurance fraud. I'm just not too sure which one it would be...it would probably be some state agency or something.

I use to own a towing company and did allot of police towing.....I got called out by the police to tow 2 burn up cars and impound them until the owner was found

Well after 3 months a State Farm adjuster showed up asking to see the cars since the owner called his State Farm agent and told him his cars where totally burned up

The adjuster looked the cars over and told me (he didn't ask me) to tow the cars to the auction pool holding yard.....then he told me State Farm doesn't pay for the impounding fees only the towing bill......hehehe.....thats when I got nasty.....I pointed to a large sign that said ALL POLICE TOWING MUST HAVE A POLICE DEPARTMENT RELEASE AND ALL FEES ARE CASH ONLY.....thats when I told him to get the proper release and bring cash payment before I will release these cars

Well another 2 months of back and forth calls to State Farm was useless so my Lawyer call them and told them if the fees are not paid within 7 days we will see them in court.....the next day a agent showed up with cash and a police release for the full amount

Moral of story "when dealing with State Farm get a Lawyer involved"

Must be a regional thing.
I've had State Farm since '74.
Several accidents with several vehicles including my '76 Harley.
They've always covered everything fully. (Had to hold their feet to the fire to get an adjuster to look at the bike though. They did end up coughing up $5,000 for repairs including the custom painted gas tanks and fender.)

My Agent has always been great to deal with.

Same here.
Except the '74 part, as I was only 7 years old

I've had State Farm since I could drive.
Same agent till just last year (he retired)

Never a problem with them.

We've only had one small issue with them before, my dad had to prove with classified ads the value of a car that burned up, but that was long ago. Other than that we haven't had a problem at all, but then again we turn never turn in small claims, thinking that when something DID happen we would get the benefit of the doubt. Well, my dad is seriously concidering switching insurance companies now, or at least agents. My agent has been no help, she just says claims takes care of it from here... He pays my insurance because we use my truck as a company truck, and he was letting me handle it, but now he said he's going in Monday to set the agent straight. The snow is going to be flying soon and I have a truck with a "normal" leaf spring that's not tracking straight

Well I was only 1 in 74, had them since I could drive and have had nothing but good luck so far.
