Yes, but it's harder to prove. The red stuff has "markers" in it. The homebrew does not, so they don't know if you bought it or made it. Also, you are allowed to make a certian amount per year before you have to pay taxes on it. It might vary from state to state.

You are allowed to make a certain amount of BIO for personal use with out paying taxes on it.

Look at it another way, you are allowed to use a Diesel Fuel additive aren't you?
